2. Purpose and Scope

These Terms of Sale govern the sale of digital products made on the website calisthenicsambition.com.

Placing an order implies full and unreserved acceptance of these Terms of Sale by the buyer.

3. Products and Services

3.1 Description

The Seller offers the following product for sale:
Calisthenics Counter Premium - Calisthenics training tracking application with AI video analysis.

      Free Version:
      Full tracking (camera + manual)
Global quality score
Progress charts
History limited to 30 sessions


      Premium Version (€14.99 - one-time payment):
      Unlimited session history
Detailed technical analysis of quality scores
Complete breakdown of performance criteria

    

3.2 Geographic Areas

The service is accessible worldwide, including Europe, North America, South America, Africa, Oceania, and Asia. No physical delivery is required, as the product is entirely digital and accessible via the internet.

4. Pricing

The Premium service price is displayed in euros, all taxes included (TTC): €14.99.

This is a one-time payment providing lifetime access to Premium features.

Prices may be modified at any time by the Seller. However, the applicable price is that in effect at the time of order.

5. Order and Validation

5.1 Order Process

The ordering process is as follows:

Order Placement: The user accesses the paywall (after 30 free sessions or by clicking "See details"). Clicking "Go Premium" redirects to the secure Stripe payment page.
Validation and Payment: The user enters payment information on the Stripe platform (PCI-DSS secured). The €14.99 payment is immediately debited upon validation.
Service Activation: Upon payment validation, Premium access is automatically activated. The user is redirected to the application with their active Premium account.
Confirmation: Payment confirmation email sent by Stripe with invoice. Premium features are immediately accessible.

5.2 No Mandatory Customer Account

The Customer is not required to create an account to make a purchase. Authentication is done via the email used during application registration.

6. Payment Methods

Payment is made by credit card via the secure Stripe platform.

Payment occurs upon order placement and is debited immediately.

The Customer may opt for an installment plan without fees offered by Stripe, if available.

7. Transfer of Ownership

The transfer of ownership of access rights to the Premium service occurs after full payment of the price by the Customer.

8. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the Customer has a 14-day period to exercise their right of withdrawal, without justification or penalties.

⚠️ Important Exception:

In accordance with Article L221-28 (13°) of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium, the execution of which has begun after the consumer's express prior consent and express waiver of their right of withdrawal.

By validating the Premium purchase and immediately activating the features, the Customer expressly agrees that contract execution begins immediately and expressly waives their right of withdrawal.

The Customer cannot cancel their order before Premium service activation.

9. Seller's Liability - Warranties

9.1 Legal Warranty of Conformity

The Customer benefits from the legal warranty of conformity provided in Articles L217-4 and following of the French Consumer Code for a period of 2 years from the purchase date.

In case of non-conformity (bugs, missing features, technical problems), the Seller will repair or replace the service within 14 days following detection of the defect.

9.2 Refund

In case of accepted refund (goodwill gesture, irreparable technical defect), the amount will be refunded within a maximum of 14 days from acceptance of the request, using the same payment method used during purchase.

9.3 No Additional Contractual Warranty

No additional contractual warranty is offered beyond the mandatory legal warranty.

10. Claims

10.1 Claim Period

The Customer has 30 days from the purchase date to file any claim concerning Premium service access.

10.3 Response Time

The Seller commits to responding to any claim within a maximum of 10 business days from its receipt.

For claims, in accordance with regulations, the Customer will receive a detailed response as soon as possible.

11. Personal Data

11.1 Processing Purpose

Personal data collected is processed solely for product sales and activation, by the company without transmission to third parties.

11.2 Data Collected

Data collected during sales includes only:

First and last name
Email address
Payment data (processed securely by Stripe, not stored by the Seller)

11.3 Retention and Data Controller

Personal data collected is reserved exclusively for the Seller.

The Seller (Ilyas ) is the personal data controller.

11.4 Customer Rights

In accordance with GDPR, the Customer has the following rights:

Right of access to their data
Right of rectification
Right to erasure (deletion)
Right to processing limitation
Right to portability
Right to object

12. Dispute Mediation

In accordance with Article L612-1 of the French Consumer Code, the Customer may use a free consumer mediator in case of dispute.

The Customer may contact the mediator after attempting to resolve the dispute directly with the Seller in writing (email).

13. Applicable Law and Jurisdiction

These Terms of Sale are subject to French law.

In case of dispute, and after attempting to find an amicable solution (notably via the mediator), French courts shall have sole jurisdiction.

14. Modification of Terms

The Seller reserves the right to modify these Terms of Sale at any time.

The applicable Terms are those in effect at the time of order placement.
